Definitions

In this document the following words and expressions shall have the following meanings:

Ski 4 Fun Transfers” shall refer to the company SARL Ski 4 Fun Transfers. (523 552 982 RCS Chambéry)
Client” shall be the person that makes the booking for themselves or on behalf of other persons.
Party” shall refer to all persons travelling under one single booking.
Passenger” shall refer to a person within a party.
Operator” shall refer to an enterprise that provides transport services via the use of their own vehicles.

Due to the highly regulated European laws governing driving and working hours within the passenger transport industry, Ski 4 Fun Transfers ask Passengers to understand the Terms and Conditions which may at times seem rather stringent.

Booking Administration

  • The Client accepts these Terms and Conditions on behalf of each member of the party.
  • Seats on a vehicle must be purchased for all infants and children regardless of age.
  • It is the responsibility of the Client to ensure that all the information on their Ski 4 Fun Transfers documents is correct. Ski 4 Fun Transfers accepts no responsibility for misinformation given by the Client that results in either a flight being missed or a driver failing to be at the collection point to pick up a passenger(s).
  • Where a booking is made by telephone, the booking is subject to, and the Client accepts the Terms and Conditions that are present on the Ski 4 Fun Transfers website at the time of booking.
  • Ski 4 Fun Transfers will issue an email confirmation and invoice upon receipt of the payment.
  • The confirmation email is the ticket. This must be presented to the driver for both the outward and return trip. 
  • Any changes to the details of the confirmed booking, including number of passengers, flight times, destination address, airport etc. may affect Ski 4 Fun Transfers ability to provide the transfer and therefore, Ski 4 Fun Transfers reserves the right to cancel the original booking if any such changes cannot be incorporated into the existing transfer schedule in which case the cancellation policy will apply (see below). The Client may have to make a new booking with the correct time and date, together with payment of the applicable tariff.
  • Any such changes must be notified to Ski 4 Fun Transfers as soon as possible.  
  • Ski 4 Fun Transfers reserves the right to charge an administration fee of 5€ for any changes to a confirmed booking that is amended at any time prior to departure.
  • It is the responsibility of the Client to provide a full and valid mobile telephone number, including the international dialling code.  If the Client does not have a valid mobile telephone number they must ensure that a resort contact number has been provided.  If it is not possible to provide either of the aforementioned, it is the Client’s responsibility to contact Ski 4 Fun Transfers on the number shown on the invoice.  Failure to do any of this may cause the Party to miss their transfer, and as such Ski 4 Fun Transfers will not be held responsible for any costs incurred as a result.
  • It is the responsibility of the Client to check for messages left on the nominated mobile telephone number during the day prior to travel.  Notification of any pick-up time changes will be by calling the nominated mobile contact number.
  • The destination and pick-up addresses on your confirmation are the address to which you will be delivered and picked up. Should you wish to change these or any other details, this must be done in writing by email at least 1 week prior to the date of travel.  
  • If no address is provided or the address provided is invalid, the Client will be picked-up/dropped-off at a central point in resort (such as the Tourist Office or train station).
  • It is the responsibility of the Client to direct the driver to their accommodation once in resort. The driver may know the specific accommodation, however in the event that neither Client nor driver know the exact location of the accommodation the driver will drive round for up to 10 minutes trying to find it, but after that will have no option but to leave the Party at the resort’s tourist office (whether it is open or closed).
  • Should more Passengers present themselves for transfer than noted in the booking confirmation it may not be possible to carry the extra Passenger(s). The extra Passenger(s) will have to make their own way to their destination and Ski 4 Fun Transfers will accept no responsibility or liability for said extra Passenger(s).

Payment & Pricing

  • Prices quoted are the current prices for the season 2010-11, Ski 4 Fun Transfers reserve the right to change the quoted price at any time.
  • For transfers requiring a driver to work between midnight and 6am there is a 50€ supplement per vehicle.
  • Payment in full is required at the time of booking. 
  • Full acceptance of Ski 4 Fun Transfers price for the service requested is assumed at the time of booking. 
  • All prices published on the website, in print, or quoted over the telephone or via email by a Ski 4 Fun Transfers representative or employee, are subject to Ski 4 Fun Transfers and its partner's Terms and Conditions.
  • The price paid by a Ski 4 Fun Transfers Client when booking a transfer is subject to change without notice. If there are any fare changes necessary after the booking has been made, Ski 4 Fun Transfers will produce written confirmation of these changes by email. If the Client does not want to accept the fare change, then the Client is free to cancel the booking, free of charge, and will be automatically refunded in full within 1 week.
  • Ski 4 Fun Transfers offers discounts to certain groups, for example Snowheads, Montalbert Owners, Les Arcs Owners etc.
  • Only one type of discount can be applied per booking, with the exception of “child” discounts as these can be applied in addition to any of the aforementioned.
  • Discounts can be withdrawn at any time, but any discounts already booked will be honoured. 
  • Ski 4 Fun Transfers reserves the right to increase prices by adding a fuel surcharge in accordance with fuel price increases.

Missed, Delayed or Cancelled Flights

  • In the case of missed, delayed or cancelled flights the Client must contact Ski 4 Fun Transfers immediately on +33 (0) 624222240  
  • If as the result of a missed, delayed or cancelled flight the Client will not arrive in time for the transfer booked with Ski 4 Fun Transfers, the said transfer is deemed to have been missed, and no refund will be provided.
  • Ski 4 Fun Transfers will endeavour to provide a new transfer where possible.  
  • If a driver is able to wait, a waiting fee will be charged for any delays exceeding one hour, which is €15 per hour or part thereof and must be settled prior to the vehicle’s departure.
  • If a driver is unable to wait, the Client may either be required to wait until the completion of other booking obligations or entirely new transfer arrangements will be made.
  • In some circumstances these new transfer arrangements will attract a further charge, although it may be waived at the discretion of Ski 4 Fun Transfers management.  Therefore Passengers are advised to check the terms of their travel insurance policy.
  • Ski 4 Fun Transfers will notify the Client in advance of any further charges. 
  • Ski 4 Fun Transfers, where applicable, will provide a written statement for the Passenger’s travel insurance provider, stating the reason why the Passenger(s) were unable to travel with Ski 4 Fun Transfers. 
  • The Client reserves the right to refuse the new transfer arrangements and organise an alternative transfer themselves, which signals the end of their contract with Ski 4 Fun Transfers. 
  • Ski 4 Fun Transfers reserve the right to change pick up times and will inform the Client by telephone call.
  • Ski 4 Fun Transfers schedule all departures to arrive at airports two hours before the scheduled departure time of a flight.  Should the Client request a pickup time that is later than the time recommended by Ski 4 Fun Transfers, Ski 4 Fun Transfers accepts no responsibility for any costs incurred due to missing a flight or onward connection.

Unforeseen Circumstances

  • Ski 4 Fun Transfers will endeavour to carry the Passenger with the minimum discomfort and inconvenience to the destination shown on the confirmation documents. 
  • Ski 4 Fun Transfers will not accept liability for costs or damages incurred in the event of a delay due to causes beyond its control. Costs of missed flights or trains etc. should be claimed from the Passenger’s travel insurance company.  Therefore, Passengers are advised to check the terms of their travel insurance policy.
  • The following are examples of circumstances which are not within the control of Ski 4 Fun Transfers, but the list is by no means exhaustible:
  • accidents causing delays to the vehicle
  • circumstances affecting passenger safety
  • compliance with requests of the police or government official
  • deaths and accidents on the road
  • exceptional or severe weather conditions
  • industrial action by third parties
  • mechanical breakdown
  • problems caused by other clients 
  • unforeseen traffic delays 
  • vandalism and terrorism
  • In the case of extremely adverse weather conditions, Ski 4 Fun Transfers may be forced to explore other transport options for the Party. This will only arise when there is a substantial risk to the Party and driver involved in attempting the journey and this decision will rest solely with the Ski 4 Fun Transfers management.  Payment for any extra transport taken will be borne by the Client; however Ski 4 Fun Transfers will provide a written statement for the Client to provide their travel insurance provider.
  • In the event that Ski 4 Fun Transfers is unable to reach the Party for the pickup time due to bad weather/road conditions, the Party must attempt to make their own way to a suitable and safe pickup point.  Ski 4 Fun Transfers will assist with advice in this matter if necessary and will try to give the Party advance warning whenever possible.  However, if this situation causes a delay in getting to the new pickup point at the agreed time, Ski 4 Fun Transfers may in some instances have to fit the Party into the next available transfer. This will be decided on a case by case basis at the sole discretion of Ski 4 Fun Transfers.
  • Force Majeure (war, civil unrest, terrorism, acts of god, etc) - If affected by any of these situations or other unforeseen events Ski 4 Fun Transfers will make every effort to deliver the Party to their destination.
  • Road or tunnel closures forcing alternative routes - Where Ski 4 Fun Transfers is able to continue to provide the transfer, a supplement is to be agreed (at the time of transfer or prior where possible) with the Client and paid on arrival in cash by the Passenger if the client has not previously agreed to pay the supplement. The amount of the supplement will reflect the extra distance, time and tolls involved to transport the Passenger to their booked destination. Where no agreement can be reached on the supplement to be paid, or where Ski 4 Fun Transfers is unable to provide the transfer on the alternative route (for example to due to other obligations, or limits on driver hours) Ski 4 Fun Transfers will transport the Passenger up to the point at which the normal route is blocked.
  • If Ski 4 Fun Transfers fails for any reason within its control to deliver the Party to the confirmed destination, Ski 4 Fun Transfers will provide suitable transport e.g. another minibus, train, private car, taxi etc.  Any reimbursement made by Ski 4 Fun Transfers for the cost of an alternative means of transport incurred by the Party to get to the ticketed destination shall be no more than the cost of getting to that destination by taxi.  Reimbursement for costs incurred will only be paid upon presentation of valid receipts.
  • In the situation that the Party is not at a specified point at the arranged time (excluding flight arrivals), and Ski 4 Fun Transfers has not previously been informed, the driver will not wait for the Party. 
  • In the situation that the Party is not at a specified point at the arranged time (excluding flight arrivals), and Ski 4 Fun Transfers has been informed, the driver will wait for a maximum of 5 minutes (Shared transfers), and a maximum of 10 minutes (Private transfers). 
  • Transport may be provided in a vehicle which does not provide the same standard of comfort as advertised. This will only occur due to unforeseen circumstances and Ski 4 Fun Transfers will not be held liable for any costs involved.  Alternative transport could be in the form of a taxi or other transfer company vehicles.

Cancellation

  • Ski 4 Fun Transfers undertakes to provide the transfer as booked.  A booking will only be cancelled due to circumstances beyond the control of Ski 4 Fun Transfers.
  • Ski 4 Fun Transfers reserves the right to cancel the booking at any time if it feels it will be unable to supply the service requested in the correct manner.
  • Failure of the Party to be at the agreed place at the agreed time may result in the transfer being cancelled, in which case the Client is not entitled to a refund. Similarly, Ski 4 Fun Transfers will not be held responsible for any subsequent costs incurred under these circumstances.
  • Cancellation of a booking must be made in writing, either by post or by email.  
  • Cancellations must be made at least 1 week before the time of travel. 
  • If the Client cancels the booking in writing more than 28 days before travel Ski 4 Fun Transfers will refund 70% of the amount paid. 
  • If the Client cancels within 28 days of travel the full payment will be forfeited and retained by Ski 4 Fun Transfers. 
  • The above payment conditions do not apply in circumstances where Ski 4 Fun Transfers has to cancel the booking due to causes beyond its control, or at its absolute discretion, agrees to cancel the booking. 
  • Ski 4 Fun Transfers will confirm cancellations by email including a cancellation reference. 
  • Ski 4 Fun Transfers will issue a statement of cancellation upon request, showing amounts paid by the Client, which the Client may then present to their travel insurance provider.

Luggage

  • All Passengers are limited to two items of luggage including a ski or snowboard bag. If any Passenger has excess luggage or baggage that is unreasonably large (e.g. very large combined board and luggage bags), the Client must advise Ski 4 Fun Transfers at the time of booking.
  • In the event of a Passenger having excess luggage or baggage that is unreasonably large without having given prior notice, Ski 4 Fun Transfers reserves the right to either charge an excess baggage allowance, whilst potentially carrying them on racks on the outside of the vehicle, or to not transport the items at all.
  • The Client should notify Ski 4 Fun Transfers at the time of booking, if the Party will be carrying more than 4 boards/pairs of skis.   
  • All luggage must be clearly labelled with the owner’s name and address and address of accommodation while on holiday.
  • Vehicles are fully insured for Passenger and third party claims, as required under French law.  Whilst Ski 4 Fun Transfers will take all reasonable care in loading and the carriage of luggage, Passengers’ property is carried entirely at their own risk and Ski 4 Fun Transfers accepts no responsibility for loss or damage.  Therefore, Passengers are advised to check the terms of their travel insurance.
  • It is the responsibility of the airline and or handling agent of the airline to deliver any lost luggage to the Passenger.

Children

  • Should any member of the Party require child seats, the Client must inform Ski 4 Fun Transfers before arrival. 
  • Failure to inform Ski 4 Fun Transfers about child seat requirements may result in the transfer being cancelled.
  • It is the responsibility of the Client to book the appropriate type of seat for the child based on the child's age and weight at the time of travel.
  • A general guide is shown below: 
     Rear facing baby seat - up to 13kgs (29lbs) approx age range: birth to 12-15 months
     Front facing child seat - from 9-18kgs (20-40lbs) approx age range: 9 months - 4 years
     Booster child seat - from 15-25kgs (33-55lbs) approx age range: 4 - 6 years
     Booster cushion - from 22-36kgs (48-79lbs) approx age range: 6 – 11/12 years

 

 

  • In the event that there is any dispute over the suitability of the chair provided, Ski 4 Fun Transfers will not be held accountable for any difference of opinion.  Therefore, to avoid this eventuality, Passengers are recommended to bring their own child seats.
  • Ski 4 Fun Transfers will endeavour to honour requests for the provision of child seats, but are not contractually obliged to do so and as such the child seats are subject to availability.
  • The child seats provided comply with all relevant legislation.
  • Passengers are responsible for the correct fitting of child restraint seats in the vehicles.
  • Whilst, French Law states children are prohibited from travelling in the front seat until aged 10 years old, Ski 4 Fun Transfers own policy states that children under the age of 13 are not permitted to travel in the front seats of any vehicle.
  • Minors between the age of 16 and 18 assume full responsibility for their use of seat belts.
  • Children under the age of 16 are not permitted to travel without a parent or guardian.
  • Ski 4 Fun Transfers offer discounted prices for children up to 13 years at the time of travel, subject to the minimum of 2 paying adults in the group.
  • Clients may not “share” children to secure discounted fares.
  • In the event of any deception by Clients, Ski 4 Fun Transfers reserves the right to withdraw the return journey and not refund the monies already paid by the Client.
  • The Client is responsible for the conduct of any children and adolescents under the age of 18 years in the party, while in the Ski 4 Fun Transfers vehicles, and will be held responsible for any damage caused by the aforementioned minors.

Smoking, Alcohol & Eating

  • Smoking and the consumption of alcohol or other illegal substances are strictly forbidden whilst travelling in any Ski 4 Fun Transfers vehicles. 
  • The consumption of food is not permitted in any Ski 4 Fun Transfers vehicles.
  • Ski 4 Fun Transfers reserves the right (and delegates to its drivers the right) to refuse to carry any Passenger who is thought to be under the influence of alcohol or other illegal substances and/or whose behaviour is considered to pose a threat to the driver, the vehicle or any other Passenger. 
  • Ski 4 Fun Transfers reserve the right to charge the Client for any damage caused to the vehicle by the Client or their Party.  This includes any exceptional internal cleaning that may be required, which will be charged at a flat rate of 150€ and is payable immediately to the driver.
  • If the Client refuses to pay, or has no money with which to pay, then the 150€ will be charged to the payment card which was used at the time of booking.  Ski 4 Fun Transfers will provide the Client with a receipt for this transaction.
  • If payment cannot be taken on the aforementioned payment card, Ski 4 Fun Transfers will cancel any outstanding transfer(s) for the Party with no refund given, and take legal action against the Client to recover the cost of cleaning the vehicle.  Such action will include all legal costs incurred by Ski 4 Fun Transfers.

General

  • Seat belts must be worn by all Passengers in all vehicles which are equipped accordingly.  
  • In case of accident, the liability of Ski 4 Fun Transfers is limited to the conditions of its insurance contract.

Agents and partners

  • Where Ski 4 Fun Transfers book transport or services provided by companies other than Ski 4 Fun Transfers, Ski 4 Fun Transfers does so as an agent for the Operator concerned, whose own conditions of carriage will apply and Ski 4 Fun Transfers’ liability shall be confined to its own services.

Changes to contractual terms

  • Ski 4 Fun Transfers may alter these terms and conditions from time to time and post the new version on the Ski 4 Fun Transfers website, following which all bookings will be governed by that version.  The Client must check the terms and conditions on the website regularly. The terms governing the purchase of a transfer will be the terms in place at the time of the booking.

Complaints, disputes

  • Any complaints or service issues should be addressed to Ski 4 Fun Transfers in writing by email. Ski 4 Fun Transfers will endeavour to resolve all service issues and respond to all complaints within 14 days of receipt.
  • Any dispute between Ski 4 Fun Transfers and a third party, if not resolved by mutual agreement shall be referred to a mediator.  However, if mediation is unsuccessful, then the matter of the dispute will be referred to a formal litigation process through the French courts.

Applicable law

  • Nothing can affect the consumers' statutory rights.
  • Ski 4 Fun Transfers shall only be liable for any reasonable and foreseeable consequential losses arising directly out of a breach in contract. 
  • Ski 4 Fun Transfers Terms and Conditions are governed by French Law.
